BASED ON THE ESTABLISHED ARTICLES 46, 47, 48 AND ALL APPLICABLE REGULATIONS OF THE STATE LAW THAT PROVIDES THE GUIDELINES FOR THE TIMESHARE CONTRACTS SIGNED IN QUINTANA ROO, AND WHAT WAS SETTLED ON THEIR FIRST ORDINARY SESSION CELEBRATED ON JUNE THIRTY OF TWO THOUSAND AND EIGHT, THE THE PROMOTION AND CONTROL OF TIMESHARE ADVISORY COMMISSION OF BENITO JUÁREZ, QUINTANA ROO.

I N V I T E S

TO CERTIFY AS A LEGALLY VACATION PROPERTY TO ALL TIMESHARE AND/OR VACATION CLUB DEVELOPERS.

Background:

The timeshare industry is undoubtedly one of the fastest-growing industries in Mexico and Quintana Roo, which represents about 42% in the country and more than 40% in the State of the quality hotel offer respectively.

To achieve this growth, the Authorities have played an important part for this evolution, monitoring that commercial activities carried out under the Law and that our visitors are satisfied, knowing that their investment is safe and willing to return to our destination.

The State of Quintana Roo and its Municipalities own the necessary legal instruments to provide certainty to all our visitors, with Advisory Commission of each Municipality in charge of monitoring that all Vacation Properties that commercialize in this modality comply with all the requirements of the Law. Our State has been characterized as the spearhead of quality and innovation for the Touristic industry, applying the different excellence certifications.

Requirements to Certify as a Legal Vacation Property.

    1.Freewriting containing the name of the natural or legal person who owns the Facility that is selling under the Touristic Timeshare Regime, the commercial name of the Company, address of the Facility and addresses to hear and receive notifications; as well as the Federal Taxpayers Registry and Local Operating License:

  • a) Original and copy for comparison of the first transcript of public deed/document in which the property title of the natural or legal person who owns the building that is being commercialized is accredited.

  • b) Original and copy for comparison of the first transcript of public deed/document in which the company certificate of incorporation is accredited, in case that a property owner is a legal person.

  • c) Original and copy for comparison of the testimony of the public deed in which it is proven that the property was affected by the Timeshare Regime.

  • d) Original and copy for comparison of the Testimony of the Public Deed of the property operating company certificate of incorporation.

  • e) Original and copy for comparison of the Testimony of the Public Deed of the property selling company certificate of incorporation.

  • f) Original and copy for comparison of the Testimony of the Public Deed containing the power of the legal representative of the developer company.

  • g) Original and copy for comparison of the Agreement between the property owner and the operator and / or selling company.

  • h) Original and copy for comparison of the Vacation Membership Purchase Agreement manifested with the Public Registry of Adhesion Contracts of the Federal Consumer Procurator.

  • i) Original and copy for comparison of the acceptance letter with the exchange company (Resorts Condominiums International or Interval International.

  • j) Copy of the acts insurance policy of total and partial losses of movable and immovable property.

  • k) Original and copy for comparison of the Internal Regulation.



The foregoing based on what is establish on the State Law That Provides the Guidelines for the Timeshare Contracts Signed in Quintana Roo, State Civil Code; The Official Mexican Norm 029 of Ministry of Commerce and- Commercial Practices- Industrial Support- Informative Requirements for The Provision of Timeshare Services ( NOM-029 SCFI-2010); The Federal Consumer Protection Law and The Federal Personal Data Protection Law.
